Terms and Conditions
Thank you for using City Choice. These Terms of Service (the "Terms") are intended to make you aware of your legal rights and responsibilities with respect to your access to and use of the City Choice website at www.citychoice.co.in (the "Site") and any related mobile or software applications ("City Choice Platform") including but not limited to delivery of information via the website whether existing now or in the future that link to the Terms (collectively, the "Services").
These Terms are effective for all existing and future City Choice customers, including but without limitation to users having access to 'restaurant business page' to manage their claimed business listings.
Please read these Terms carefully. By accessing or using the City Choice Platform, you are agreeing to these Terms and concluding a legally binding contract with City Choice(formerly known as City Choice) and/or its affiliates (excluding City Choice Grocery and other Daily Use items) (hereinafter collectively referred to as "City Choice"). You may not use the Services if you do not accept the Terms or are unable to be bound by the Terms. Your use of the City Choice Platform is at your own risk, including the risk that you might be exposed to content that is objectionable, or otherwise inappropriate.
In order to use the Services, you must first agree to the Terms. You can accept the Terms by:
- Clicking to accept or agree to the Terms, where it is made available to you by City Choice in the user interface for any particular Service; or
- Actually using the Services. In this case, you understand and agree that City Choice will treat your use of the Services as acceptance of the Terms from that point onwards.
Shipping policy
1. All offers availed by a customer are agreed between customers and City Choice Partners alone. The term ‘offer’ shall include but not be limited to price, taxes, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. We do not have any control or do not determine or advise or in any way involve ourselves in such offers. We, however, might offer support services to City Choice Partners with respect to order fulfilment, payment collection, call centre, and other services, pursuant to independent contracts executed by us with these City Choice Partners.
2. City Choice makes no representations or warranties with respect to the specifics of the products purchased by the customer (such as legal title, creditworthiness, identity, quality, value, etc.) of any of the City Choice Partners. You are advised to independently verify the bona fides of any particular City Choice Partner that you choose to deal with on the Platform. City Choice shall not accept any liability for any errors or omissions, whether on behalf of itself or third parties.
3. City Choice operates as an online marketplace and assumes the role of facilitator, and does not at any point of time during any transaction between the customer and City Choice Partner on the Platform come into or take possession of any of the products or services offered by such City Choice Partner. City Choice does not hold any right, title or interest over the products, and therefore shall have no obligations or liabilities in respect of such contract entered into between the customer and City Choice Partner.
4. City Choice merely provides a platform for customers to place Orders and any such Order shall be construed to be an agreement between the customer and City Choice Partner. In the event a customer raises a complaint with respect to the food product delivered, City Choice shall notify the relevant City Choice Partner and shall also redirect the customer to the consumer call center of the City Choice Partner. The City Choice Partners shall be liable for resolving customer complaints. In the event a customer raises a complaint on the Platform, City Choice shall assist the customer in resolving the same at the best of its abilities.
5. We shall not be responsible for any non-performance or breach of any contract entered into between the customer and the City Choice Partner on the Platform. We do not guarantee that the concerned customer and/or City Choice Partner will perform any transaction concluded on the Platform. We shall not be responsible for unsatisfactory or non-performance of services or damages or delays as a result of products which are out of stock, unavailable or back ordered.
6. City Choice charged a particular delivery Fee extra for the specific product which is buyer demand on our platform. the charges applicable depends on the basis of kilometer. the minimum delivery charge sum of rs. 16/-. City Choice not taken any delivery charges within 3 kilometer.
7. All food and grocery items delivered same day with in 1-2 hours maximum within 15 kilometer.
8. if any item not available or wrong or worst or destroyed at the time of delivery the full payment refunded within 1-2 working days respectively on same account.
